AGID, J. -- Francisco Gomez appeals his conviction for possession with intent to deliver a controlled substance on the grounds that: (1) the trial court did not balance his prior convictions on the record before admitting them into evidence; (2) the trial court abused its discretion in admitting his prior convictions as "unnamed felonies"; (3) he was entitled to, but did not receive, a lesser included offense instruction; (4) he received ineffective assistance of counsel; (5) the trial court improperly admitted testimony under ER 804(b)(3); and (6) there is insufficient evidence to support his conviction. We reverse his conviction and remand because we are not persuaded that the trial courts failure to balance the probative value of his numerous prior convictions against the prejudicial effect of admitting them was harmless error.
